1. Agreement to Terms

By accessing or using the RapidCharge mobile application and services ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use our Services.

2. Description of Services

RapidCharge provides electric vehicle charging services through our network of charging stations located in Kosovo. Currently, we operate 2 charging stations in Prishtina, with plans to expand our network across the country.

Our Services include:

• Location and availability information for charging stations
• Reservation and payment processing
• Real-time charging session management
• Usage history and analytics

3. User Accounts

3.1 Registration

To use our Services, you must create an account and provide accurate, complete information. You are responsible for maintaining the confidentiality of your account credentials.

3.2 Account Security

You agree to:

• Keep your password secure and confidential
• Notify us immediately of any unauthorized account access
• Accept responsibility for all activities under your account

3.3 Account Termination

We reserve the right to suspend or terminate your account for violations of these Terms or for any reason at our discretion.

4. Use of Charging Services

4.1 Proper Use

When using our charging stations, you agree to:

• Follow all posted instructions and safety guidelines
• Use only compatible electric vehicles
• Not damage or tamper with charging equipment
• Vacate the charging station promptly after your session ends
• Not block access to charging stations for other users

4.2 Pricing and Payment

Charging fees are displayed in the app and may vary by location and time. All payments are processed through ProCredit Bank's secure payment gateway. By using our Services, you agree to our Refund Policy, which states that all payments are non-refundable.

4.3 Reservations

Reservations are subject to availability. If you fail to arrive within 15 minutes of your reservation time, your reservation may be canceled and the reservation fee forfeited.

5. User Conduct

You agree not to:

• Use our Services for any illegal purpose
• Interfere with or disrupt our Services or servers
• Attempt to gain unauthorized access to our systems
• Harass, abuse, or harm other users
• Upload malicious code or viruses
• Violate any applicable laws or regulations

6. Intellectual Property

All content, features, and functionality of our Services, including but not limited to text, graphics, logos, and software, are owned by RapidCharge and protected by international copyright, trademark, and other intellectual property laws.

7. Disclaimers and Limitation of Liability

7.1 Service Availability

We strive to maintain service availability but cannot guarantee uninterrupted access. Charging stations may be temporarily unavailable due to maintenance, technical issues, or other factors beyond our control.

7.2 Limitation of Liability

To the maximum extent permitted by law, RapidCharge shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our Services.

7.3 Vehicle Damage

While our charging stations are designed to be safe, we are not responsible for any damage to your vehicle resulting from the charging process. Users are responsible for ensuring their vehicle is compatible with our charging equipment.

8. Privacy

Your use of our Services is also governed by our Privacy Policy. Please review our Privacy Policy to understand how we collect, use, and protect your information.

9. Modifications to Services and Terms

We reserve the right to modify or discontinue our Services at any time without notice. We may also update these Terms from time to time. Your continued use of our Services after any changes constitutes acceptance of the new Terms.

10. Indemnification

You agree to indemnify and hold harmless RapidCharge, its officers, directors, employees, and agents from any claims, losses, damages, liabilities, and expenses arising from your use of our Services or violation of these Terms.

11. Dispute Resolution

Any disputes arising from these Terms or your use of our Services shall be resolved through good faith negotiations. If negotiations fail, disputes shall be resolved in the courts of Kosovo.

12. Governing Law

These Terms are governed by the laws of the Republic of Kosovo, without regard to its conflict of law provisions.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

14. Entire Agreement

These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and RapidCharge regarding your use of our Services.
